Terms & Conditions
1) Definitions
- Frances Jean / we / us / our: the seller.
- Customer / you: the buyer.
- Consumer: an individual buying wholly or mainly outside their trade/business.
- Trade Customer: a business buyer (including wholesale partners, interior designers, contractors, developers).
- Made to order: produced specifically for your order (including selection of finish, upholstery, dimensions, or specification).
2) Orders, acknowledgement and acceptance
- When you place an order, you will receive an automated email acknowledging receipt. This does not constitute acceptance.
- A contract is formed only when we send a Confirmation of Order (or written confirmation on invoice/proforma), confirming:
- the goods ordered
- the price
- the estimated lead time and/or delivery timeframe
- We reserve the right to refuse or cancel an order (for example due to availability, pricing/description errors, or payment issues). If we cancel before dispatch, we will refund sums paid for the cancelled item(s).
3) Product descriptions, pricing and natural variation
- We take reasonable care to ensure website and quotation information is accurate. If we discover a significant error affecting your order, we will contact you to reconfirm or cancel for a refund.
- Prices are in GBP and include VAT unless stated otherwise.
- Colour, finish and materials may vary between screens and in different lighting.
- Our pieces are handmade using natural materials. Variations in grain, veining, tone, texture and finish are normal characteristics and do not constitute faults.
- Measurements are approximate and within a reasonable tolerance.
4) Availability and lead times
- All items are subject to availability.
- Lead times vary by design and are estimates unless expressly agreed in writing. Lead times may extend during peak periods (including Christmas and Summer holidays).
- If an item is subject to a significant delay, we will notify you as soon as reasonably possible.
5) Payment
5.1 Website checkout
Orders placed via website checkout are charged in full at the time of purchase unless otherwise stated.
5.2 Made-to-order (deposit + balance)
For made-to-order furniture orders placed via quote, invoice or trade purchase order:
- A 60% deposit is required to confirm your order and commence production.
- The remaining 40% balance is invoiced when your piece is complete (or deemed complete and ready for delivery/dispatch).
- The balance is due within 7 days of invoice and must be paid in full and cleared no later than 48 hours prior to the scheduled delivery/dispatch time.
- We do not schedule delivery/dispatch or release goods until full payment has cleared.
- If payment is not received by the due date (including the 48-hour requirement), delivery/dispatch will be paused and rescheduled once payment is received. Reasonable storage/redelivery costs may apply where incurred.
By placing an order, you confirm the payment details are valid and that you are authorised to use the payment method provided.
6) No additional commercial warranty
We do not offer an additional commercial warranty. This does not affect statutory rights. If goods are faulty, not as described, or not fit for purpose, you may be entitled to remedies under applicable law (which may include repair, replacement or refund depending on the circumstances).
7) Intellectual property
All content on our website and in our materials (including photographs, drawings, designs and text) is owned by or licensed to Frances Jean and may not be copied or used without prior written permission.
8) Limitation of liability
Nothing in these Terms limits or excludes liability where it would be unlawful to do so. Subject to that, we will not be liable for indirect or consequential losses, and our total liability relating to an order will not exceed the amount paid for the goods giving rise to the claim.
9) Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, subject to any mandatory consumer protections that apply.
10) Trade Customer notes (applies only to Trade Customers)
- Quotes are valid for [14] days unless stated otherwise.
- Unless agreed in writing, sale-or-return is not offered.
- Trade Customers are responsible for confirming specifications, site access, and suitability for the intended environment/use.
- Any specific trade terms (discount structure, exclusivity, MOQs, display pieces) must be agreed in writing and will override general statements where they conflict.
